Mandatory vs. Dispositive Law

  • Mandatory (zwingendes Recht / droit imperatif): Cannot be contracted away. Includes consumer protection, employment law minimums, unfair contract terms. Identify these in every contract.

Court Document Structure

Klageschrift (Complaint / Demande / Azione)

Components (per ZPO Art. 221):

  1. Rubrum: Court designation, parties (plaintiff/defendant), subject matter, Streitwert
  2. Rechtsbegehren (Antrag): Specific relief requested. Must be clear and definite.
    • Format: "Es wird erkannt:" / "Par ces motifs:" / "Si chiede:"
  3. Sachverhalt: Chronological fact narrative in numbered paragraphs. Reference exhibits (Beilage 1, 2...).
  4. Rechtliche Wurdigung: Legal analysis applying law to facts. Use Gutachtenstil. Cite statutes and BGE.

Berufung (Appeal / Appel / Appello)

  • Must specify which parts of judgment are challenged

Gutachtenstil (Legal Reasoning Style)

Use this structure for all legal analysis in court documents and opinions:
